One Therapy - Confidentiality and Data Protection

Confidentiality

Everything that is discussed is genuinely completely confidential, it will not be shared or communicated to others in any form except in the six highly unusual circumstances described below.

1. If for any reason we agreed that it would be helpful to involve a third party, such as a partner or a GP etc., then we would discuss and agree this before making any contact, and we would agree the limits of what could be discussed with the specific people.

2. Where information is required by an organisation responsible for meeting the cost of your treatment and payments are conditional upon you receiving treatment, then a report is made available to qualified medical staff. Such information will not be provided without your prior written consent.

3. In very exceptional circumstances a therapist has a duty to prevent serious harm to others. In these very exceptional circumstances where there is a serious future risk to others, especially children or other vulnerable groups, then the therapist will take appropriate steps to help prevent the harm. Normally this would involve discussing and agreeing with the client how this could be achieved.

4. Again, in very exceptional circumstances, a County Court Judge can order disclosure of confidential information held by a therapist or doctor.

5. In pursuance of a defence made by a therapist, who is accused of breaching the Code of Ethics, only so far as it is necessary and provided that such information is supplied only to those who are empowered to conduct an investigation.

6. If without the prior written consent of the therapist, you choose to publish (by electronic or other means) or otherwise make public the nature of any treatment, AND in the opinion of the ethics committee of the BACP or GHR, the public information may bring the profession into disrepute AND professional arbitration has failed to resolve the matter (example; publication of a book, radio, web page extract).

Data Protection

Records of treatments, payments are retained on an encrypted computerised filing system solely within the United Kingdom.

Data is held for a minimum period of three years.

Clients are provided with supervised access to copies of these records during office hours, provided reasonable notice is given.

Subject to the written application and payment (by cheque) of £8.50, copies of the notes may be posted to the last known address held on our records. The records will be posted (by registered delivery) within thirty days of the funds clearing into our account.

To request a copy of your data, please write to the contact address, stating your full name, date of birth, address when receiving treatment.

We hold ourselves accountable, both to our members, and to the general public, for ensuring that hypnotherapy is a safe, ethical and well-trained profession. The Society is not run for profit, paying only an administrator’s salary, with all other monies used to support the Society and help it to grow.

The Society is an Organisational Member of the British Association for Counselling and Psychotherapy (BACP), and, as such, is bound by that organisation’s Code of Ethics and Complaints Procedure. We aim to be ethical, open, and transparent in all our procedures.
